Why this case

The Italian Garante’s ChatGPT decision of 30 December 2024 (Provvedimento 551/2024, €15M fine against OpenAI) is the most useful teaching case currently available for the EU AI Act classification specialist. Two facts make it useful: it is a recent European AI enforcement action at meaningful scale, and it is structurally analogous to what the AI Act’s Chapter VII enforcement procedures will look like even though the decision itself is formally under the GDPR. The specialist who studies the Garante decision carefully will recognise the enforcement pattern when it recurs under the AI Act in 2026–2027.

The case is cited in Article 6 of this credential at a high level. This case study goes deeper, tracing the factual history, the Garante’s reasoning, OpenAI’s responses, and the implications for the specialist’s operational crosswalk.

Timeline

The case unfolded over almost two years, from an initial provisional order to the final fine.

The procedural arc — provisional order, cooperation, remediation, final sanction — is the same arc the AI Act’s Chapter VII enforcement procedures will exercise. The specialist should study the arc itself; it will generalise.

The Garante’s findings

The Garante identified four overlapping compliance failures. For each finding below, this case study first summarises the Garante’s GDPR reasoning, then names the Article(s) of the EU AI Act that would be the analogue basis for a post-2026 enforcement in the same facts.

Finding 1 — no lawful basis for training-data processing

The Garante held that OpenAI had not established a valid GDPR Article 6 lawful basis for processing personal data scraped from the open internet for training purposes. OpenAI had relied on legitimate interest (GDPR Article 6(1)(f)); the Garante found the interest-balancing inadequate given the volume and sensitivity of processed data.

EU AI Act analogue:

  • Article 10 (data and data governance) — training-data governance obligations for high-risk systems, interacting with Article 10(5) on special-category data processing for bias detection.
  • Article 53 (GPAI provider duties) — copyright-compliance policy and training-content-summary duties. The Garante’s reasoning on Article 4(3) of the Copyright in the Digital Single Market Directive (EU) 2019/790 reservations-of-rights, referenced in the decision, is directly incorporated into Article 53.

Finding 2 — inadequate transparency to users

The Garante found that ChatGPT’s disclosures about AI nature, data processing, and output-generation mechanisms were inadequate for users to understand and exercise their rights.

EU AI Act analogue:

  • Article 50(1) — transparency duty to natural persons interacting with an AI system.
  • Article 13 — provider transparency to deployers (where the ChatGPT API is used downstream).
  • Article 53 — GPAI provider downstream-integrator information duty.

Finding 3 — absence of age-verification

The Garante found that ChatGPT’s self-declaration age gate was insufficient to prevent children under 13 from accessing the system, in breach of GDPR Articles 8 (children’s consent) and 25 (data protection by design and by default).

EU AI Act analogue:

  • Article 5(1)(b) — exploiting vulnerabilities of age-based groups. Not directly triggered by ChatGPT’s generic service but a flag for any AI system where age-based vulnerability is in play.
  • Article 50(1) — transparency to natural persons, informed by age-appropriate design.
  • Article 9 (risk management) — foreseeable-misuse analysis should have identified child access as a risk requiring specific mitigation.

Finding 4 — inadequate information about OpenAI’s identity and contact points

The Garante found that OpenAI’s EU-facing contact and representation was insufficient for Italian data subjects to exercise GDPR rights.

EU AI Act analogue:

  • Article 54 (authorized representative for non-EU GPAI providers) — formalises the contact-point duty the Garante was enforcing in the 2023 provisional order.
  • Article 22 (authorized representative for high-risk non-EU providers) — same pattern for high-risk systems.

The penalty architecture

The €15M fine sits in the middle of a notional AI Act penalty envelope. Under Article 99 of the AI Act, this band of finding — substantive-obligation non-compliance, not Article 5 prohibition — would fall under the middle band capped at €15M or 3% of worldwide annual turnover. OpenAI’s worldwide annual turnover at the time of the decision is the 3% denominator.

For the specialist, two observations:

  • The Garante’s €15M landed squarely in the AI Act middle-band territory. National competent authorities will calibrate their AI Act fines to the GDPR enforcement tradition they already operate within; €15M is a credible reference point for substantive-obligation non-compliance by a large multinational.
  • The compliance-remediation-plus-institutional-communication-campaign remedy is a form the AI Act will preserve. The Garante ordered OpenAI to run a six-month institutional communication campaign in Italy explaining ChatGPT’s data-processing. The AI Act’s Article 99(7) contemplates non-monetary corrective measures alongside fines; the Garante’s remedy previews how those will be deployed.

OpenAI’s remediation

OpenAI’s April 2023 remediation package included: an age-verification declaration (still self-declaration but with explicit prompting and consequences); an opt-out form for users to request that their personal data not be used for training; a transparency page explaining ChatGPT’s data processing; and an updated privacy policy covering EU users’ rights specifically.

The remediation did not resolve all Garante concerns — the final 2024 decision still imposed the €15M fine — but it did allow ChatGPT to resume Italian service. The pattern is relevant to the specialist because it shows that partial remediation reopens the market while keeping the enforcement file active. Organisations should not assume that cooperation and remediation fully extinguish liability; they may moderate the final quantum.

Cross-provider learning — not just OpenAI

A narrow reading of the Garante case would be “OpenAI got fined.” A wider reading the specialist should adopt is that the case establishes four templates that apply to every GPAI-backed consumer-facing system in the EU, regardless of upstream provider:

  1. Transparency to end users must survive an informed-user test. Generic “this is AI” disclaimers will not suffice; the disclosure must enable the user to understand, opt out where applicable, and exercise rights.
  2. Training-data lawful-basis analysis must pre-exist deployment. A provider that reaches the point of EU rollout without a defensible lawful-basis analysis — for GDPR purposes now, for Article 10 / 53 purposes from 2026 — is already in enforcement territory.
  3. Age-verification and child-protection are specific risks requiring specific controls. Self-declaration is not a sufficient control where the system is accessible to children and carries age-specific risks.
  4. EU contact / authorized-representation must be a genuine operating presence. The AI Act’s Articles 22 and 54 formalise what the Garante was already enforcing.

These templates apply equally to Anthropic, Google, Meta, Mistral, Alibaba Cloud, Tencent, AI21, Cohere, and every other major and minor GPAI provider supplying the EU market. The specialist treats the Garante decision as precedent for an enforcement pattern, not a one-off against a single provider. Transfer to other enforcement authorities

The specialist should not assume every national competent authority will enforce in the Garante’s style. The Dutch DPA’s enforcement pattern — large structured fines with detailed factual narratives, as in the Toeslagenaffaire childcare-benefits case — differs in tone and procedural rhythm. The French CNIL’s enforcement is more frequent and generally smaller per-incident. The UK ICO, while outside the EU AI Act, applies analogous reasoning in its enforcement of facial-recognition cases (Serco Leisure, discussed in Article 3 of this credential). Spanish AESIA, the first dedicated national AI supervisor, is still building its enforcement archive.

The unifying discipline: every national competent authority will enforce within the procedural framework of Articles 99 and 101 of the EU AI Act, but their factual reasoning styles, remedy preferences, and public-communication patterns will differ. The specialist monitoring enforcement should track at least three authorities in parallel — the Garante, the Dutch DPA, the French CNIL, and AESIA — to build a composite view of what EU enforcement will look like in practice.

Discussion questions for the specialist

  1. If the Garante decision had been issued under the EU AI Act rather than the GDPR, which Article 99 band would the substantive findings have triggered? Which specific Article 99(4) factors would the Garante have weighed?
  2. OpenAI’s April 2023 remediation let ChatGPT resume service in Italy. Would an equivalent remediation package, delivered during a post-2026 AI Act enforcement action, be sufficient to reduce a fine below €15M? Which AI Act provisions would structure the reduction?
  3. The Garante ordered a six-month institutional communication campaign as a non-monetary remedy. What operational mechanism in the specialist’s organisation would execute such a remedy if ordered? Is it the same mechanism that executes Article 50 transparency duties, or a distinct one?
  4. Several of the Garante’s findings (transparency, age-verification, lawful basis) have AI Act analogues in multiple Articles. When drafting the obligation-to-control crosswalk, how should the specialist allocate the control to primary versus secondary Articles, to avoid double-counting in the evidence pack?
